A woman told the court that Hoggard strangled her during the sexual assault, causing her to fear for her life

TORONTO – An Ottawa woman told a Toronto court on Tuesday that Canadian musician Jacob Hoggard strangled her hard enough to make her fear for her life that he sexually assaulted her in his hotel room more than five years ago.

The woman, the second complainant in Hoggard’s sexual assault trial, testified that she agreed to meet the singer in Toronto in November 2016, roughly two weeks after the two crossed over via dating app Tinder.

The woman said she knew they were meeting for sex, but Hoggard raped her anally, vaginally and orally, slapping her repeatedly and spitting in her mouth. She said he called her a pig and a slut, and called her “kind of pig noise.” She said he did not use a condom.

She said that Hoggard once pulled her from the bed to the bathroom by her legs. She said he sat on her chest on the tile floor and said he would pee on her, then ask her to pee on him, and she refused both.

The woman testified that at another point, Hoggard choked her so badly that she could not breathe.

“I thought he might kill me,” she testified, adding that she was worried no one would know where she was.

Hoggard, head of Hedley’s squad, pleaded not guilty to two counts of sexual assault causing bodily harm and one count of sexual interference, which is a charge of sexually touching a person under 16.

An Agreed Fact Sheet says he had a sexual encounter with both complainants after they came to the hotel on separate occasions in the fall of 2016. Neither woman can be identified under the embargo.

The complainant, who testified on Tuesday and is now in her late twenties, recalled getting up early to take the train to Toronto on November 22, 2016 – it is an agreed fact in the case that Hoggard bought the ticket – and would meet him at the Thompson Hotel.

He went down to fetch her from the hall and they went up to a room together, and Hoggard told her his regular room was not ready yet, she said.

The woman testified that as soon as she entered he pushed her against the wall and violently tried to kiss her. She resisted, and Hoggard seemed furious, and told her she could go home, she said. She said she thought it was “rude,” but had nowhere else to go.

She said Hoggard had been drinking something and told her it was “lean”. She said he looked ecstatic and seemed to blink a little.

Finally, she witnessed a knock at the door, and someone told them that Hoggard’s room was ready. Hoggard went first and told her to come after him, which she did, she said.

“That’s when he pushed me on the bed and raped me,” she said, tearing up the stage.

The woman testified that Hoggard was acting “like a psychopath” during the encounter and that she was afraid of him. “His eyes were so terrifying,” she said.

She said it was like Hoggard became a “different person,” noting that he had been kind in all of their conversations before that day. She said she wouldn’t have gone to see him if she had expected him to act this way.

After that, Hoggard called her a taxi and drove to Tim Hortons near the train station to wait for her return to Ottawa, she told the court. She said she felt “numb”.

She said Hoggard texted her while she was in the cab, saying it was a great time and he can’t wait to see her again. The woman said she felt “extremely confused and disgusted” after receiving his letter.

“He knows what he did and I don’t know why he would say that after doing that to someone,” she said.

The woman said she never planned to tell anyone about what happened, except for a few close friends, but that she went to the doctor five or six days after the accident because she was worried she might have a tear in her vagina.

“I didn’t think anyone would believe me, because I went there thinking we were going to have consensual sex and I was raped instead,” she said.

In 2018, she gave an anonymous interview with CBC and later went to the police, she said.

The other complainant, who was 16 at the time, testified that Hoggard repeatedly raped her vaginally and orally, and she attempted to do so anally, on September 30, 2016.

She told the court that she was brought to the Hoggard Hotel by limousine and expected that they would spend part of the day together shopping and sightseeing.

She also testified that the singer groped her backstage after a show in Toronto in April 2016. Defense attorneys noted that the alleged harassment did not occur.

They also suggested that the two had consensual sex and that the young woman made up a “rape story” because she was embarrassed to be “used” by the rock star she had romantic feelings for.
